Based on Part 3 of Article 49 of the Civil Code of the Russian Federation, examination of project documentation is not carried out in relation to sections of design documentation prepared for the overhaul of capital construction facilities (https://xn--c1adkmgpem4hrai.xn--p1ai/page/stroitelno-montazhnye-raboty) (hereinafter referred to as the OKS), except for cases where the estimated cost of the overhaul of the OKS is in accordance with Part 2 of the article 8.3 of the Civil Code of the Russian Federation is subject to verification for the reliability of its determination. In this case, according to clause 2 of part 5 of article 49 of the Civil Code of the Russian Federation, the subject of the state examination is only checking the reliability of the determination of the estimated cost. At the same time, if the estimated cost of major repairs of the OKS in accordance with the requirements of the Civil Code of the Russian Federation is not subject to verification for the reliability of its determination, then in accordance with clause 2 of part 3.3 of Article 49 of the Civil Code of the Russian Federation, the developer or technical customer can send design documentation for major repairs OKS for conducting state or non-state examination on its own initiative. The form of the examination and the body (organization) for conducting the examination are determined in accordance with the requirements of parts 3.4, 4.1, 4.2 and 4.8 of Article 49 of the Civil Code of the Russian Federation.
