In accordance with Part 12.2 of Article 48 of the Civil Code of the Russian Federation as amended by Law No. 342-FZ, in the case of major repairs of capital construction projects financed with funds from the budgets of the budget system of the Russian Federation, funds from persons specified in Part 1 of Article 8.3 of the Civil Code of the Russian Federation, estimate documentation is prepared on the basis of an act approved by the developer or technical customer containing a list of defects, and the developer’s or technical customer’s instructions for design depending on the content of work performed during major repairs of capital construction projects.
Moreover, the developer, on his own initiative, has the right to ensure the preparation of other sections of the project documentation. If capital repairs are financed using other funds, the preparation of project documentation is carried out at the initiative of the developer.
